In November 2024, more than 40 pet dogs died of suspected poisoning in Guangzhou. More than 20 pet dogs were poisoned with rat poison in a community in Fengtai, Beijing.
In Ms. Zhao’s community, some people show off poisonous dogs in the pet group, and then resident Uncle Li’s Pomeranian “Pudding” died of poisoning while walking, and two pet dogs were also poisoned on the same day, but fortunately rescued. Guangxi Mr. Zhang’s dog “match” died of kidney failure due to isoniazid poisoning, because the incident is not monitored and the legal definition is vague, the alarm is difficult to make progress. Stray cats were also poisoned on a college campus in Hubei province, killing nine and even torturing their corpses, making students angry and upset. In northern rural areas, stray dogs are often killed in winter, and villagers feel that it is not illegal.
The investigation found that the poisoners used isoniazid and believed that it was not illegal, and social platform groups were still discussing ways that poison dogs were not illegal. Lawyers say cyanide is highly toxic, and isoniazid is also highly toxic to dogs. The pet was poisoned, the owner was physically and mentally damaged, like Mr. Zhang no longer updated the video, Uncle Li blamed himself, the students were also upset, and the owner also suffered economic losses.
The frequent poisoning incidents include community conflict, poisoning caused by complaints about barking and pet waste, and psychological distortion of the poisoners. Lawyers pointed out that poisoning pets violates public order and good customs and may lead to crimes. From a legal point of view, poisoning pets is suspected of the crime of placing dangerous substances, and it is also necessary to bear civil compensation. However, pet protection laws in China lag behind, pet value assessment in criminal law is difficult, civil law compensation is difficult to cover spiritual loss.
Judicial practice has been toxic dog punishment cases, such as Heilongjiang Sha Mou, Wang Mou poisoned 11 dogs were sentenced. Experts believe that whether the poison dog behavior is a crime needs specific analysis, killing dogs with isoniazid poison is illegal, and meeting certain conditions constitutes the crime of intentionally destroying property; The determination of the crime of putting dangerous substances should be comprehensive and multi-factors, the circumstances can be punished by public security, and the poisoning in public places caused by human ingestion will be punished severely.
