Alaska Airlines is currently facing a lawsuit alleging that the airline is responsible for the death of a beloved French Bulldog, Ash. The dog tragically died after both Ash and his owner, Michael Contillo, were forced to move from first class to coach during a flight from New York to San Francisco earlier this year.
Background of the Incident
According to the lawsuit, filed by Contillo, he had purchased first-class tickets for himself and his father in February 2024, specifically to ensure a more comfortable flight for himself and his two dogs. Contillo also paid an additional $100 for each pet, as they were supposed to board early and have ample space. However, just before takeoff, the airline personnel instructed them to move from their seats in the fourth row of first class to a row in the main cabin for “safety purposes.”
Claims of Negligence and Emotional Distress
Contillo informed the flight attendant that he was concerned the move would cause his dogs significant anxiety, potentially leading to dangerous breathing and heart issues. Despite his protests, both he and his father were relocated to different seats with even less space for the dogs.
The lawsuit states that Ash began to exhibit signs of distress, including rapid and heavy breathing, shortly before takeoff. Contillo attempted to close the dog’s carrier to alleviate his anxiety but was unable to check on Ash until the plane reached cruising altitude. During the flight, Contillo noticed that Ash had stopped moving, and by the time they landed in California, the dog was reportedly in rigor mortis, suggesting he had died hours earlier.
Lack of Sympathy from Crew
The complaint further alleges that no crew member, including the pilot, offered any sympathy or condolences upon landing. Contillo expressed his grief, noting that none of the staff showed concern for the loss of his pet.
Prior to the flight, both of Contillo’s dogs had been evaluated and deemed fit to fly. The lawsuit emphasizes that Ash was a healthy, active dog with no previous health issues.
Legal Action and Damages Sought
As a result of this incident, Contillo is suing Alaska Airlines for breach of contract, negligence, negligent hiring and supervision, and negligent infliction of emotional distress. He is seeking punitive damages, which will be determined during the trial.
This tragic case highlights the importance of understanding airline policies and ensuring the comfort and safety of pets during air travel.
